Financial coaching is an educational and collaborative service. We provide information, tools, guidance, and support to help clients make their own financial decisions.
3. Professional Boundaries and Disclaimer
Pen Your Path provides financial coaching and education, not regulated financial advisory services.
Unless separately agreed to in writing and appropriately licensed, Pen Your Path does not provide:
- Individualized investment recommendations or securities advice
- Investment portfolio management or securities transactions
- Tax preparation or individualized tax advice
- Legal advice or legal representation
- Insurance product recommendations or sales
- Debt settlement or debt collection representation
- Credit repair services or guarantees of credit score improvement
- Mental health counseling, therapy, or medical advice
Pen Your Path does not act as an investment adviser, attorney, CPA, licensed therapist, or debt settlement company.
Coaching may include general education about retirement accounts, student loans, credit, insurance, taxes, debt relief, and other financial topics. However, clients are encouraged to consult appropriately licensed professionals before taking actions that require specialized advice.
Clients remain solely responsible for their financial decisions, transactions, and actions taken as a result of coaching.
4. Client Responsibilities
Financial coaching works best as a collaborative process.
By participating, clients agree to:
- Provide information that is accurate and complete to the best of their knowledge.
- Participate actively in coaching sessions.
- Communicate openly about financial goals, concerns, and changing circumstances.
- Make their own financial decisions and independently verify important information when appropriate.
- Complete any agreed-upon exercises or action steps to the extent reasonably possible.
- Treat the coach and others involved in services respectfully.
- Attend scheduled sessions or provide the required notice when a change is needed.
Clients are not required to disclose information they are uncomfortable sharing. However, incomplete or inaccurate information may limit the usefulness of coaching recommendations.
Pen Your Path does not control client accounts, authorize transactions, or make financial decisions on behalf of clients.
5. No Guarantee of Financial Results
We are committed to providing thoughtful, supportive, and professional coaching. However, each client’s financial situation is different.
Pen Your Path does not guarantee specific outcomes, including:
- Debt elimination or creditor settlements
- Improved credit scores
- Loan approvals or interest-rate reductions
- Increased income or savings
- Investment returns or retirement outcomes
- Acceptance into hardship or government assistance programs
- Achievement of any particular financial goal
Results depend on numerous factors, including income, expenses, financial circumstances, personal decisions, creditor policies, and market or economic conditions.
Examples, calculators, worksheets, and projections are provided for educational purposes. They are estimates rather than guarantees.
6. Appointments and Virtual Coaching
Coaching sessions are generally conducted virtually through Google Meet or another mutually agreed-upon communication platform.
Clients are responsible for:
- Scheduling appointments through the designated booking system.
- Providing accurate contact information.
- Attending sessions at the scheduled time.
- Having a suitable internet connection and functioning device.
- Participating from a reasonably private location when discussing confidential financial information.
Session lengths are described at booking.
Late arrivals: Sessions generally begin and end at their scheduled times. If a client arrives late, the session may proceed using the remaining scheduled time without an extension or partial refund.
If a client is more than 10 minutes late without contacting the coach, the appointment may be considered a missed session and may be forfeited without refund.
We understand that unexpected situations happen and encourage clients to communicate as soon as possible.
7. Payments and Fees
All prices are stated in U.S. dollars unless otherwise indicated.
The fee for each service will be disclosed before purchase or booking. Prices may vary depending on the service, package, or promotion.
Unless otherwise agreed in writing:
- Individual coaching sessions must be paid for in advance.
- Coaching packages are paid in advance or according to an expressly agreed payment schedule.
- Payment is processed through an authorized third-party payment processor, such as Stripe.
- Services are not transferable to another person without prior written approval.
- Any applicable taxes or additional charges will be disclosed before payment.
- A booking is confirmed once required payment and scheduling requirements have been completed.
Pen Your Path does not retain full payment card numbers through its ordinary checkout process.
Any installment arrangement will identify the total purchase price, payment amounts, due dates, and cancellation terms before the client agrees.
Pen Your Path reserves the right to pause future services when an agreed payment is overdue, subject to applicable law and the individual service agreement.
8. Cancellations, Refunds, and Rescheduling
We recognize that schedules change and unexpected circumstances arise. To respect both the client’s time and the time reserved for coaching, the following standard policies apply to individual paid coaching sessions unless a different policy is clearly disclosed before purchase.
Client cancellations
24 hours or more before the appointment: Clients may cancel and request a refund of the session price, less any nonrecoverable payment-processing charges where permitted by law and disclosed at purchase.
Less than 24 hours before the appointment: Cancellations are generally nonrefundable.
Rescheduling
Clients may reschedule an eligible session up to two times, provided:
- At least 12 hours’ notice is given.
- The rescheduled appointment occurs within 30 days of the original purchase, unless another period is agreed to in writing.
- An available appointment time can be arranged.
Additional rescheduling requests may be declined.
Missed appointments
A missed appointment without adequate notice is generally considered a completed or forfeited booking and is not refundable.
Coach cancellations
If Pen Your Path must cancel a session, the client may choose to reschedule within 30 days or receive a full refund for the affected session.
Exceptions
We recognize that medical emergencies, family emergencies, and circumstances outside a client’s control can occur. Requests for exceptions may be reviewed individually.
Any exception offered in one situation does not automatically change the standard policy for future appointments.
Nothing in this section limits refund rights that cannot legally be waived.
9. Coaching Packages and Multi-Session Programs
Pen Your Path may offer multi-session packages that include financial coaching, YNAB assistance, educational materials, and limited between-session support.
Each package’s description or Coaching Agreement will specify:
- Total price and payment schedule
- Number and length of sessions
- Services and educational materials included
- Duration of the coaching engagement
- Scheduling expectations
- Availability and duration of email or messaging support
- Expiration dates, if applicable
- Early termination and refund terms
Packages must be used within the period disclosed at purchase or agreed to in writing.
Package cancellations and refunds
Once coaching has begun, completed sessions and services already delivered are not refundable, except as required by law.
Any refund for unused prepaid coaching services will follow the applicable package terms disclosed before purchase.
If no separate package refund policy was provided, clients may request cancellation of remaining services and a prorated refund for undelivered coaching sessions, using the allocation of fees stated in their agreement or purchase confirmation.
Any applicable deduction must be disclosed, permitted by law, and explained upon request.
Refunds are returned through the original payment method when reasonably possible.
An individual Coaching Agreement may establish additional package-specific terms, but it will not eliminate nonwaivable consumer rights.
10. Ongoing Support and Recurring Subscriptions
Some coaching offerings may provide ongoing monthly support or recurring services.
Not all coaching packages automatically renew. A fixed-duration package ends according to its stated terms unless the client separately agrees to continue.
If an offering includes automatic renewal, Pen Your Path will clearly disclose before enrollment:
- The recurring payment amount and billing frequency
- The renewal term
- Whether and when the price may change
- Any minimum commitment
- How and when to cancel
- When cancellation becomes effective
Recurring charges will be made only with the client’s authorization.
Clients may cancel an automatically renewing service using the cancellation method supplied at enrollment and in the confirmation materials. For online enrollments subject to Colorado automatic-renewal requirements, a direct online cancellation method will be provided.
Cancellation will stop future renewals or charges according to the disclosed terms and applicable law. Unless otherwise stated, the client may continue using already-paid services through the end of the paid billing period.
Any applicable renewal reminders or material-change notices will be provided as required by law.
Third-party software subscriptions purchased directly from another provider must be canceled through that provider.
11. Confidentiality and Privacy
We understand that discussing personal finances requires trust.
Pen Your Path treats information shared during coaching as confidential and uses it for the purpose of providing services and managing the client relationship.
We do not disclose identifiable client financial information to unrelated third parties without the client’s permission except:
- When legally required, including a valid court order or other lawful obligation
- When reasonably necessary to provide services through authorized technology providers
- With professional advisers or service providers who have appropriate confidentiality obligations
- When necessary to address a serious and immediate safety concern, as permitted by law
- When the client has provided authorization
Confidentiality in financial coaching is not the same as attorney-client privilege or a legally protected therapist-patient relationship.
Financial information and document security
Clients may share budgets, spending information, debt balances, credit reports, and other relevant financial documents during coaching.
Clients should not send passwords, banking login credentials, full Social Security numbers, or complete payment card information through ordinary email or messaging systems.
Pen Your Path will use reasonable administrative and technical safeguards appropriate to the information and services involved. However, no online communication or storage method can be guaranteed to be completely secure.
Additional information about how personal information is collected, stored, used, and retained is provided in our separate Privacy Policy.
12. Third-Party Platforms and Budgeting Software
Pen Your Path may use third-party services for scheduling, meetings, payment processing, client communications, and budgeting support.
These may include Google Meet, TidyCal, Stripe, and YNAB.
Third-party services operate under their own terms, privacy policies, pricing, and technical requirements.
Pen Your Path is not responsible for independently operated platforms’ outages, product changes, billing decisions, security incidents, or technical limitations, except to the extent the law imposes responsibility on Pen Your Path.
Software subscription costs are not included in coaching fees unless expressly stated in the purchased service description.
Clients remain responsible for maintaining their own software accounts and understanding any applicable subscription charges.
13. Communications and Between-Session Support
Clients may contact Pen Your Path using the communication methods provided as part of their coaching service.
Email or messaging support between sessions is available.
Unless expressly stated otherwise:
- Email and messaging support are intended for reasonable coaching-related questions.
- Responses are provided during normal business availability.
- Immediate or emergency responses are not guaranteed.
- Messaging support does not replace scheduled coaching sessions.
- Coaching availability and included support end when the purchased service period concludes.
Pen Your Path does not provide emergency financial, legal, or mental health services.
14. Client Materials and Intellectual Property
Worksheets, spreadsheets, guides, templates, written materials, website content, graphics, and other educational resources created by Pen Your Path remain the intellectual property of Pen Your Path LLC unless otherwise stated.
Clients who receive materials as part of coaching are granted permission to use those materials for their own personal, noncommercial financial planning.
Clients may not sell, redistribute, publish, or commercially reproduce proprietary materials without written permission.
Clients retain ownership of the personal financial information and documents they provide during coaching.
Third-party resources remain subject to their respective owners’ terms and rights.
15. Session Recordings and Testimonials
Coaching sessions will not be audio- or video-recorded by Pen Your Path without the client’s prior permission.
Clients should obtain the coach’s consent before recording sessions.
Pen Your Path will not publish identifiable client testimonials, personal stories, financial details, or coaching results for marketing purposes without appropriate authorization.
Clients may decline a request to provide a testimonial without affecting their access to coaching services.
16. Ending the Coaching Relationship
Either the client or Pen Your Path may request to end an ongoing coaching relationship.
A client may discontinue coaching by providing written notice. Payment and refund obligations will be determined under the applicable service or package agreement and applicable law.
Pen Your Path may discontinue or decline services when:
- A client’s needs fall outside the appropriate scope of financial coaching.
- Required payments remain outstanding.
- Repeated scheduling issues substantially prevent delivery of services.
- A client engages in threatening, harassing, abusive, or inappropriate behavior.
- Continuing the relationship would create a significant professional, ethical, or legal concern.
When appropriate, Pen Your Path may recommend that a client seek assistance from another qualified professional.
Any unused prepaid services will be addressed in accordance with the applicable refund policy and legal requirements.
17. Limitation of Liability
Pen Your Path provides financial education and coaching in good faith, using reasonable care and professional judgment.
To the fullest extent permitted by applicable law, Pen Your Path is not responsible for financial losses resulting from decisions independently made by clients, changes in economic conditions, actions of creditors or other third parties, or reliance on incomplete or inaccurate client-provided information.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, or other conduct for which limitations are prohibited by law.
Any additional limitation of liability in an individual Coaching Agreement must be reasonable, clearly disclosed, and consistent with applicable law.
18. Website Use
Information on penyourpath.org is provided for general educational and informational purposes.
Visitors agree not to use the website to engage in unlawful activities, attempt unauthorized access, interfere with its operation, or misuse website content.
Website information may be updated as financial laws, regulations, services, or educational guidance change.
Articles, calculators, resources, and general educational content should not be treated as individualized professional advice.
Links to third-party websites are provided for convenience and do not necessarily constitute endorsement of their services or recommendations.
19. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado, except where applicable law requires otherwise.
If a client has a concern about coaching services, payments, or these Terms, we encourage them to contact Pen Your Path first so we can attempt to resolve the issue fairly.
Concerns may be submitted to: krish@penyourpath.org
Nothing in these Terms limits a client’s right to contact a government regulator, file a lawful complaint, or pursue legal rights and remedies available under applicable law.
Any legal proceedings will be handled in a court with proper jurisdiction, subject to applicable consumer protection laws.
20. Changes to These Terms
Pen Your Path may revise these Terms & Conditions to reflect changes in services, business practices, technology, or legal requirements.
The most current version will be posted on our website with an updated effective date.
Material changes affecting an existing paid coaching agreement will not retroactively change that agreement without appropriate notice or consent where required.
21. Acceptance of Terms
By purchasing coaching services, checking the applicable acknowledgement box, signing a Coaching Agreement, or otherwise expressly accepting these Terms, clients acknowledge that they have had the opportunity to review and understand them.
Website visitors are also expected to comply with the applicable website-use provisions.
If a signed Coaching Agreement or written service-specific contract conflicts with these general Terms, the more specific agreement will govern that service, subject to applicable law.
22. Contact Information
